Labor Dispute Resolved concerning Security Agency and its Employee

Mr. Stanley Destacamento receive Php 12,286.39 worth of quitclaim from ABC RMO Security and Investigation Agency, Incorporated, when both parties agreed on an amicable settlement as a result of the Single Entry Approach (SENA) of the Department of Labor and Employment-NCR  Makati Pasay Field Office on April 12, 2017.

The SENA arose from the complaint filed by Mr. Stanley Destacamento on March 20, 2017 on his claims of his employer’s underpayment on wages, non-payment of overtime and night-differential pays, unfair labor practice, illegal dismissal, non-compliance with the Occupational Safety and Health Standards, and unauthorized deductions on his uniform and health card.

A SENA Conference was scheduled on April 3 & 10, 2017 with Mr. Jason Prestado as the hearing officer. Mr. Destacamento demanded the amount of P200,000.00 from the responding party, represented by Ms. Marlyn Camaddu and Mr. Dino Piamonte.  However, Mr. Destacamento, refused to accept the company’s offer of Php 12, 286.39. With this, the parties agreed to set another conference to provide ample time for the responding party to consult their management for possible consideration of Mr. Destacamento’s demand.

During the last conference presided by Mr. Mark Avner Acosta, details of the complaint were further discussed and Mr. Destacamento agreed to accept the company’s offer, in a quitclaim executed by both parties. After three conferences, an amicable settlement was achieved and the labor dispute between the two contending parties was finally resolved. END/Mark Avner Acosta
